This statement is for labour employed by another person (a subcontractor or party hiring out staff) who come to perform work for us.

Why we collect your personal data
On behalf of our subcontractor or the party from whom we have hired you, you will perform work for us. In connection with this work, we will record some personal data. We are happy to explain why we collect your data.
If your employer fails to pay payroll taxes or VAT, the Tax Authorities may hold us liable. To limit the risk of this, we need to keep proper records. These records must show the identity of the workers we have employed. For foreign workers, we must also be able to prove that they are allowed to work in the Netherlands.

Sometimes processing your personal data is required by law. In other cases, we have a legitimate interest. By knowing who comes to work for us, we can limit our liability risk towards government bodies such as the Tax Authorities and avoid imposing fines under the Foreign Nationals (Employment) Act. For these reasons, you are therefore obliged to provide your data. If you do not want to provide personal data, you may not perform the work for us and we will not allow you to enter the place where the work takes place.

We receive some of your personal data from your employer. These include your Citizen Service Number and, in the case of workers from abroad, sometimes also copies of identity documents. Your employer is required by law to provide us with this data. In the case of cross-border service provision requiring notification to the UWV, we also ask your employer for a copy of the notification form with the UWV (without copies of work and residence permits). This form contains personal data about you.

What do we ask of you?
Before starting work, we will ask you to show us a valid and original proof of identity, from which we will take some personal data.
We also want to check whether you are allowed to work in the Netherlands during the period of the work. We will therefore ask you for your residence and/or work permits. For our records, we will make a copy of these - on the advice of the Social Affairs and Employment Inspectorate. We will also copy any A1 certificate you may have. We make these copies because we want to be able to prove to government bodies at a later stage that we have only employed people with the correct documents and to defend ourselves properly against any additional charges and fines.

Retention period personal data
We retain your personal data for a period of seven years after the end of the financial year in which the work ended. This period corresponds to the period during which we are obliged to keep our records for the Tax Authorities. We will retain copies of identity documents and any residence and work permits for five years after the end of the year in which the work ended in connection with the Foreign Nationals (Employment) Act.

Provision to third parties
We may have to allow inspection of our records or prove your identity or right to reside and/or work in the Netherlands to the Tax Authorities, the Social Security and Employment Inspectorate, the UWV or the Social Insurance Bank. In that case, we are obliged to provide your personal data to them.

Passing on your BSN to contractors and hirers
Where appropriate, you will perform work on our behalf for a contractor or we will hire you out to another party. If we fail to pay our payroll taxes or VAT to the tax authorities, the tax authorities may hold the contractor or hirer liable. To limit the risk of this, the contractor or hirer must keep records that allow them to prove who has worked for them. Part of these records is the Burgerservicenummer. We are legally obliged to provide your BSN to the contractor or user company.

Your rights
You have the right to ask us to access your own personal data. If warranted, you can also ask us to supplement your personal data or amend inaccuracies. In addition, you have the right to ask us to delete your personal data or restrict the use of your personal data. You can also object to the collection and use of your data with us. Finally, you can request us to obtain your personal data or transfer it to another person.

You cannot exercise the above rights in all circumstances. For example, if we need your personal data to comply with the law, you cannot object or request erasure.
